What’s an AWS DMCA Takedown?

If you’re a content creator, it can be tough to understand why creators’ works are copied, stolen, misused, or used without permission. Perhaps it is because the thieves have misconstrued the words of Albert Einstein that said, “Creativity is contagious; pass it on.” Einstein definitely didn’t want people to pass creative work on with or without the owner’s permission or for commercial purposes😂! That’s where the AWS DMCA takedown comes in.

Let’s explain that further. We can’t blame people for liking good works or wanting to use those works for informational purposes. But if they must use them, isn’t it best to use these works the right way with permission from their respective owner?

We designed this article to help you take control of what people do with your works and intellectual 🧠 property and to prevent unauthorized access of usage. That brings us to what you’ve probably been wondering: what is DMCA takedown copyright notice? What is AWS? And what is AWS DMCA takedown? And finally, what purpose do they serve? Stay with us, and you’ll find out😊.

What Is a DMCA Takedown Notice?

A DMCA (Digital Millennium Copyright Act) takedown notice is a formal petition served in the name of a copyright owner or by the copyright owner. They have the sole purpose of taking down or removing any of the copyright owner’s property that is being used a) illegally or b) without the owner’s permission. The sender can serve any platform on which the infringement is taking place with such a notice. DMCA takedowns are created in accordance with the provisions of the Digital Millennium Copyright Act of 1998 in the United States.

The Cliff Notes version? A DMCA takedown notice is a means of informing the platform owners or service provider about a problem. The problem, in this case, is that the content or work being used on their platform (which may be a website or blog) is being used illegally. Therefore, it infringes on the copyright owner’s rights and ultimately breaks copyright laws. Because of this, the copyright holder requests that such work be immediately taken down from the service provider’s platform. If the platform doesn’t follow through, they may receive copyright infringement action.

Cool, right?🤨 Let’s continue!!!😁

What Is Amazon Web Services (AWS)?

Amazon launched Amazon Web Services, or AWS for short, as a subsidiary of Amazon in 2002. It has the sole purpose of providing services that have to do with information technology to individuals as well as businesses. AWS has grown and evolved to provide important services, including some of the following:

  • Application Programming Interface (APIs)
  • Cloud services
  • AWS CloudWatch
  • Amazon CloudWatch logs
  • CloudWatch events
  • Development resources
  • An app developer portal
  • Cloud computing platforms

AWS provides these to a wide clientele on a pay-as-you-go method of payment, which of course, is metered. AWS hosts websites, blogs, and other online platforms. It also provides technical services to websites 🌐, blogs, and other businesses.

What Does AWS Have to Do with a DMCA Takedown?

You might be wondering what a DMCA Takedown and something as technical as AWS have in common. Understandable! Take Pinterest, Netflix, or the Splunk app as examples. Pinterest increased its storage and functions using some of AWS’s services and AWS resources, just like Netflix has.

Now, let’s say any of these platforms or one of their users allegedly perpetuate copyright infringement by using unauthorized works or illegal content. The copyright owner of the original content may choose to serve a DMCA takedown notice to the platform as well as to AWS directly. They can point out the copyright issues and threaten copyright infringement claims or copyright infringement lawsuits if the platform doesn’t take action.

Upon receipt of this notice, and in a bid to remain protected under Safe Harbor, AWS can issue an AWS DMCA takedown notice to the user. This new notice references the original DMCA takedown notice they received from the copyright owner as well as the platform’s copyright policy. It instructs the platform to comply with the original notice directive or provide a counter – notice as soon as possible. This internal takedown notice also normally stipulates that failure to act can result in account suspension (temporary or permanent) due to copyright protection issues.

Now that you are familiar with the above concepts, let us take this a step further. In this next section, we’ll intimate you with what you need to do to file an AWS DMCA takedown. This is the interesting part, so don’t go anywhere🙂!

How to File an AWS DMCA Takedown

Most copyright owners have, at some point or the other, had infringers use their works without permission. We understand that this can be very frustrating! This is why we want to show you what to do to curb this before resorting to a copyright lawsuit.

Do you feel a platform hosted by AWS is using your work without your permission? First, confirm whether the user is the fair use doctrine or if accidental copyright infringement is at play. If neither of those scenarios apply, you might choose to reach out to AWS directly on the issue. You can do this with a complaint of copyright infringement by serving an AWS DMCA takedown.

Are you ready to move forward with your copyright claims dispute? Time to time, it’s the only course of action that makes sense. Here are the steps for sending an AWS DMCA takedown for your copyright-protected material.

1. Write a Substantially Compliant AWS DMCA Takedown Notice

A substantially compliant notice must include the following elements:

  • An introduction of the sender and copyright owner
  • Stipulation of AWS involved product names
  • Identification of copyrighted work and infringing material
  • Identification of the infringer
  • Proof of copyright ownership
  • A statement of good faith belief
  • A penalty of perjury statement
  • Physical signature or electronic signature
  • The contact information of the sender or copyright owner

We know; that’s a lot! Wondering how to get this done without leaving anything out? Not to worry! Get our comprehensive customized DMCA takedown notice template at very affordable costs here.

After preparing the AWS DMCA takedown request, the next step is to send your notice to the AWS body in charge of copyright abuse using the URL ec2-abuse@amazon.com or abuse@amazonaws.com. Once you’ve done that, AWS will kickstart your AWS DMCA takedown in a bid to uphold their safe harbor protection. You’ll receive feedback in the average response time (they will likely notify you of what this is).
